Michael Anglicized name to Fouts when he obtained land at Pipe Creek, Prince Georges County, MD in 1744.
Michael was the oldest son of Jacob but undoubtedly was given the double name of Jacob Michael Fouts. There was no Jacob Fouts, or any other male Fouts in the Germany Twp. area, with a wife named Caterana that is unaccounted for. Michael and young John Adam Varner migrated to Rowan County, NC in 1762-3 and signed documents for for one another. There is no question in the membership of the Fouts Association that Michael's wife is any other than Catharana Varner. The Verner's are reported to be Mennonite
Michael crossed the Atlantic while a babe in arms, along with his father, mother and older sister, Anna Margaretha. Their arrival in America took place prior to September 1727 at which time the first Ship Lists and Oaths were established. They settled on a hillside farm in or near the small German village of Skippack, Philadelphia (now Montgomery) Co., about 20 miles northwest of Philadelphia, where they remained for the next fourteen years.
When Michael was about 14 years of age a second relative from Germany arrived at Philadelphia and joined his family, Theevia (Theobald/Dewald/David), of about the same age, arrived on the Ship "Davy" in1738, and came directly to Skippack. The relationship is unknown, but most likely the two boys were Cousins once removed, and became inseparable friends for the remainder of their lives.
Michael and Catherine lived on Little Pipe Creek Waters, Frederick (now Carroll), MD 1744-1762, moved to Uwharrie Waters in Rowan, NC in 1763.
The actual date of death is missing and he was not probated in either Randolph, NC or Montgomery, OH

In 1800, Michael, Sr, was apparently living with son John and grandson Michael, Jr., to sell off all of the lands they owned, individually and jointly, in North Carolina. It was Michael, Sr's last appearance in public records. He may have remained in Randolph Co, with son Andrew or have gone north with John (Jacob moved north in 1801). He was not probated in NC or OH.

Considering that this family had been promoted as a "Quaker" family since Lindsey Brien (Dayton, OH) found some association with the Presidential Hoover line in the early 1930s, it is easy to understand why they could not be found in Quaker records.
Michael at 20 years old was ready to strike out on his own, in the company of his kinsman, David (Theobald) Pfautz. Both took out land on Pipe Creek waters along the Maryland border, not far from Hanover. On August 1744, Michael obtained his first Land Survey Warrant - following quoted in full - Prince Geo County ss
"By virtue of a Warrant Granted out of his Lordships Land Office of this Province unto l Michael Fouts of Prince Georges County for Fifty acres of Land bearing date by Renewment the 29th day of August Anno Domini 1745, I therefore certify as Deputy Surveyor of Prince Georges County under his Excelle Thomas Bladen Esqr Governor of Maryland I have carefully laid out for & in the said County called "Michaels Fancy", beginning at three bounded White Oak Trees standing on ye East Side of Hans's Branch, being a draft of little Pipe Creek & running thence North Fifty Four Deg West Fourteen Per, then North Fifty Six Deg East Per, then North Eighty one Deg East Sixty Per, then South Forty Five Deg East One Hundred and Four Per, then by a strait line to ye beginning Trees, Containing and now laid out for Fifty Acres of Land, to be held of Calverton or Minorcocee Mannor, Surveyd this 30 day of August Anno Domini 1745. Michael Fouts, Patent for 50 Acres, called "Michael's Fancy" - August 30, 1745 - Thomas Bladen, Esqr., Lieutenant General and Chief Governor of Province of Maryland, to Michael Fouts, of Prince Georges County in Province of Maryland, 50 acres called "Michael's Fancy" laid out according to Certificate of Survey bearing date of August 30, 1745, and returned to the Land Office, said lands being in his Lordship's Manor of Calverton or Minorcocee. With his 50 acre homestead firmly established, Michael was ready for a wife, and the following year, about spring of 1746, he married Catherine Varner, daughter of Adam Varner of Germany Twp., Lancaster (later York) Co., PA. Having sold his property, he was granted a Warrant for 91 acres, bearing the date 20 July 1749, called "Clear Meadow", lying on the Great Bear Branch, a draught of Pipe Creek...There follows a drawing of the survey in the general shape of a tomahawk with a fat handle. Michael has lived on his second farm about five years when on 28 August 1754, he sold to Henry Cassell, both of Frederick Co., 91 acres called "Clear Meadow"...Michael's wife Catherine relinquishes Dower interest. (Frederick Co., Deeds E:527).
Michael's third farm, located on Pipe Creek in Frederick (now Carroll) Co., MD, was Surveyed on 20 February 1761. The 55 acres was first settled and named "Carolina" by Andrew Stiger who had apparently sold or abandoned his claim on the property. Michael's Certificate was issued on 12 Dec 1762. Soon thereafter, word reached York County that the Cherokee War was over in Western NC and that the waters of the Uwharrie (Rowan Co) was open for settlers. The Pfautz families wasted no time in preparing for this move and in the summer of 1762, as of one mind, Michael, his father Jacob, his kinsman David and brother-in-law Andrew Hoover, sold all of their holdings in Maryland and Pennsylvania within two months time. (Have previously cited Jacob's Deed of 2 July 1762. (York Co, Book A:568).
(In Abstract) 4 June 1762 Michael Pfautz of Frederick Co., MD., assigned his interest in a tract of 55 acres, called "Carolina" located on Great Pipe Creek, to Gasper Rowland. Wife Catherine relinquishes Dower interest. (Frederick Co., Deeds, 4 June 1762). Note that the deed reads "assigned his interest". By the time that the Patent was issued, 11 December 1762, Michael was either in North Carolina or on his way there.
Michael and David in their prime, along with other interrelated families of Hoover, Mast, Waymire, and Yount, traveled a wilderness road for a distance of about 400 miles as the crow flies. It was the second time when these faithful companions set forth on a journey in search of a better homeland. At this time Michael and is wife, Catherine (Varner), were the parent of 7 children - John 16, Catherine 14, Andrew 12, Elizabeth 10, Susanna 8, Magdalena 4 and Jacob about 18 months.
On 17 February 1763 the following obtained Henry McCulloh Deeds on the Waters of Uwharrie in Rowan Co., NC. Note the English spelling of the name. (Deed Book 5; pages 332-415)

22 Feb 1763 Andrew Hoover bought an additional 289 acres.
This is the earliest Uwharrie Dutch Settlement with the exception of William Merrill. The Uwharrie until 1771 were located in Rowan Co. In 1771, they, in most part, were taken within the newly erected Guilford Co. In 1779, the southern portion of Guilford, wherein they resided, was included in the newly formed Randolph County.
Dr. Davenport secured an area Map Maker who, from the deeds, plotted the land of the early Fouts on the Uwharrie. He secured over 3,000 land entries or deeds (property bought or sold) of the early Fouts and related families, covering Rowan, Davidson, Guilford and Randolph Counties. There are over 300 who are related, in some manner, to Michael and his son Andrew. Sufficient to say, Michael, Sr. owned land on the Uwharrie at the junction of the Rich Fork and North Fork and along both sides of North Fork.
Of interest - Guilford Co. Land Entry No. 1632, made 7 May 1779, by James Allen is described as "a tract or parcel of land containing 100 acres lying in between Michael Fouts' Mill and Harmon's improvement"...Inasmuch as the Fouts Mill does not appear in Randolph County records, we can assume that it was not a public mill, but was used privately. That it was a grist mill is evidence by the designation of "John Fouts, miller" in 1792 (Michael's oldest son). If it was a saw mill, he would have a a "sawyer", and if a Filling mill, he would have been a "fuller"

Within Michael, Sr.'s own family there was a great diversion of faiths. Michael and his wife, Catherine, were both "Dutch Friends", otherwise know as Mennonites. His son John's progeny were largely identified with the Dunkers (Church of the Brethren); daughter Catherine's religious persuasion unknown, but her husband Lawrence Younce, was identified with the Dunkers; Andrew was a Baptist; Elizabeth Yount was a Dunker; and Esther Yount was Dunker.
At the beginning of the Revolutionary War, in 1775, each Poll was expected to take the Oath of Allegiance to the State of North Carolina, serve in the Militia, agree to bear arms, and pay taxes for the support of the war effort. The German's with few exceptions took the stance of "Pacifists" and refused
to take the Oath, etc. As a result they lost their Civil Rights, which included purchasing land, until the end of the war when they were restored in 1787. Michael and his children, with the exception of Andrew who married into the very patriotic Merrill family , were pacifists. During the 12 year interim many of the Germans lost, or were literally pushed off, their lands. It was not a happy place for the non-conformists -- the Mennonites, Dunkers, Quakers and Moravians.
When the Uwharrie Dutch, with large families, needed more acreage, they were forced to seek out lands in the mountainous country of Wilkes-Ashe Counties, NC in the 1780's; in Kentucky in the 1790's and in the Northwest Territory (Ohio) in the late 1790's and early 1800's.
Old David appears to have been the leader of the Uwharried German community, for he was appointed "overseer of the Trading Road, from the Painted Springs east across the Uwharrie to Caraway Creek", by the Rowan County Court in 1768 (Rowan County, NC Court of Pleas & Quarter Session Minutes, 2:17). He was the only German to be so recognized before 1771.
Bro. George Soelle, the Moravian Missionary from Old Salem made 12 visits (46 days) on the Uwharrie and recorded in his Diary that he "never got south of Michael Fouts' place." He held his first meeting at Dewald (David) Fouts, Sr.'s place on 18 November, he wrote in his Diary -- "This is a unique species of people. They appear to me like Aesop's crow which inflated itself with other birds' feathers. They have Moravian, Quaker, Separatists, Dunker principles, know everything and know nothing, look down on others, belong to no one, and spurn others. Just one soul inspired some hope in me, with whom I was also able to converse, namely, Dewald's wife, whose frivolity is getting to be a burden to her and often oppresses her. (This could be his second wife). She, also was the only one there who asked me to visit more frequently when I should return to that region. . . This Dewald has a lot of children who have been bline since birth." (David, Jr.'s children)...Old David Fouts was a hardheaded German according to Soelle who wrote that he "met stubborn resistance when I tried to enlighten him". Soelle stayed at David's one night when he "lost his way to Hoover's and had to turn back at Michael Fouts". On another occasion he wrote, "I often experience among such folks what Soloman says, "A fool ofter asks more questions than a wise man can answer". In general, he thought the Uwharried Germans a "course lot".
Other families remained on the Uwharrie for a brief time, picking up the few parcels of available land. Sample deeds -

In the fall of 1803, Michael, Sr. joined with his son John (the miller) and grandson, Michael, Jr., to sell off all of the lands they owned, individually and jointly, in NC. Father, son and grandson had so mixed-up their lands on the Uwharrie that it was impossible to make sense out of their individual Land Registers. However, when all three are put together in terms of what land they obtained and what land they deeded away, that account balances withing three acres. It was Michael, Sr.'s last appearance in Public records. It is believed that Michael, Sr., died in 1803, or soon thereafter, in Randolph Co., NC.. Likewise, it is possible that he went with his oldest son John and grandson, Michael, Jr. to German Twp., Montgomery Co., Ohio, where they made their Entries in the summer of 1804.

LAND: 200 acres, 17 Feb 163, North Carolina Land Grants, 19: 445-449. Following was a letter written by Charles Merit Fouts, c 1935 with copies to member of his family. Charles M. 1868-1939, a lawyer in Seattle.
"John Fouts and his family moved from Randolph County, North Carolina, and located on a 160 acre tract in what is now Preble County, Ohio, within a traingle drawn through Eaton, Germantown and Johnsville (New Lebanon) and about 6 miles southwesterly from Johnsville. (R. Brown finds Eaton in Preble Co, Germantown in Montgomery Co, but Johnsville is not to be found in that area). Here were gathered his family and the families of his descendants, especially Michael 1st and Michael's son Michael until he was married to Mary Etter, grandmother of Charles M. Fouts, and especially by Aaron Fouts youngest son of Michael 1st and his family. (The land) was recently sold to Mrs. Myers, the mother-in-law of Harry M. Wolfe, an attorney at law offices in 401 Reibold Building, Dayton, Ohio. John Fouts and wife Mary, Michael Fouts 1st and wife Elizabeth Sinks Fouts, Aaron Fouts and others of the Fouts tribe and of the Etter tribe are buried in the same graveyard within said triangle. When said John Fouts and family were moving from Randolph County, North Carolina, to Ohio, they crossed the Ohio River near where Cincinnati is now located. The city was then being laid out. The John Fouts family had in their possession a very fine young horse and the founders of the said city offered 30 lots in what is now the business district of Cincinnati for the young horse. John and Mary settled on Twinn Creek in German Twp, Germantown,
Montgomery CO, OH. The family had resided in Pennsylvania long enough to be good judges of land and shrewly made their settlements along creeks and rivers.
The family located on 160 acre tract in what is now Preble Co, OH within a triangle drawn through Eaton, Germantown and Johnsville (Johnsville is now a part of New Lebanon). Here were gathered his family and the families of his descendants, especially Michael 1st and Michael's son Michael until he was married to Mary Etter, grandmother of Charles M. Fouts and especially by Aaron Fouts youngest son of Michael 1st and his family. John Fouts and wife Mary, Michael Fouts 1st and wife Elizabeth Sinks Fouts, Aaron Fouts and other of the Fouts tribe and the Etter tribe are buried in the same graveyard within said triangle.
Due to several Fouts bearing the given name of "John" he was known as "The Miller". In the fall of 1803, John, The Miller, and his son Michael, Jr. sold all of their holdings in NC and moved to Mongomery, OH

John Scott Davenport, PH.D., May 1, 1970 "Younce is not Yount" Younce-Janss. Young-Jundt. In the early 1940's William M. Younce, an elderly gentleman in Delray, Florida, who was intertested in genealogy came to the Janss conclusion and obtained the original marriage bond of John Fouts and Mary Yonce, Rowan Co., NC, Aug 31 1769. The name on the Bond is clearly Mary "Younce". In correspondence with Jon M. Burkett and Col. Kephart, the experts, Mr. Younce was told that Younce was Yount. He, therefore, gave up pursuing his original Jans family. "I would point out also that the Marriage Bond of John Fouts and Mary Younce was obtained in Salisbury with Daniel Little as Bondsman and Thomas Frehock as Witness. Little was a German, an Attorney at Law, and a Lutheran, who did no business (per records) East of the Yadkin River. Frohock was the County Clerk who issued the Bond. This smacks of an elopment.
Mary Younce is a decendant of Wilhelm Janns who reached gthis country on 5 September 1738, on the ship "Winter Galley" or "Winter Calbey" fronm Rotterdam, Holland.
"...Incidentally, the Moravians say Jans is Danish and that the German form of the name is Tschantz, the lattr form appears in Mennonite records and now appears as Johns among both the Mennonites and the Dunkers."

Catherine was involved in a scandal during the Revolution, and she apparently went to live with another man, with whom she had several children who went under the name of Fouts. She was apparently living in Frederick Co., MD in 1790

For some reason during the Revolution, Catherine left Lawrence and took up with William Trusty. Lawrence took their children and moved to Lincoln Co., NC. In 1786, William Trusty and Catherine Younce Fouts were indicted by the Randolph Co., NC Grand Jury for adultery and bastardy. Lawrence had a 200 acre entry, which he apparently turned over to Catherine as a settlement - anyway, she got the State Grant. I've never been able to find her conveyance of the land, but Jacob Garron had it by 1790. Suspect that Catherine is the formal head of household, Catherine Yontz in the Frederick Co., Md. Census of 1790, which shows but one young male child.
Date and place of Catherine's death is unknown.

Laurence moved from Lincoln Co. to Wilkes Co., NC before the Census of 1790, is enumerated there n that could well be a motherless family.
Laurence Sr., apparently married off Lawrence, Jr., in Wilkes (now Ashe) Co., and went back to Lincoln Co., but he did not stay there for long. After a few years of land and slave activity he sold out in Lincoln Co.
Lawrence is buried one grave away, from Mary Younce Fouts (two from John Fouts in the same plot. The tombstone reads" LAWRENCE YOUNCE, August 1814, aged 75 years". He was nine years older than Mary. He is the only Younce buried amoung a great many Fouts
Helen Silvey also has met some of the Younce's in Muhlenberg Col., KY. The family is still quite strong among the Dunkers (Church of the Brethren)."

The Fouts Family is of German Descent and it is believed was first represented in America by the grandfather of Andrew, Jacob Pfoutz.
Birth date agrees with Andrew's birth recorded in the Pfautz family "Bible" page owned by Norman G. Fouts of Southfield, MI
Standing as sponsors were Jacob and Magdalena Pfautz (grandparents). The baptism is recorded
Andrew was the third child of Michael Fouts, Sr. and Catherine Varner. He was born on a farm called "Clear Meadows", lying on the Great Bear branch of Great Pipe Creek of Frederick (now Carroll) County, along the Maryland/Pennsylvania border.
Andrew is the only bona fide Patriot, DAR-type, in this family. Andrew took the oath of allegiance to the state of North Carolina, was among the first in Randolph Co. to receive a land grant. His father-in-law, William Merrill, was a Militia Captain, Justice of the Peace, and fatality of the Revolution. There are several documents in the NC Archives, Randolph Co, files, which indicate that Andrew and the Merrill's cross-bonded each other on occasions.
In regards to Andrew's childhood, his father Michael Pfautz sold his land along the Maryland/Pennsylvania border in 1762, as did his kinsman David (Dewald) and several other related families of Hoover, Mast, Waymire & Yount, and journeyed a distance of about 400 miles, as the crow files, and formed a Dutch Settlement on the waters of the Uwharrie in Rowan Co., NC, where they all obtained deeds on 17 February 1763.
At the time of the exodus, Andrew was about 12 years of age and, no doubt, enjoyed the adventuresome journey, camping out and traveling slowly through the wilderness country with his numerous cousins. It was a "never-to-be-forgotten" experience for the children - and perhaps we should add - for the women in the company. Andrew's mother had 7 children at the time between the of ages of 16 years and 18 months. After reaching the "promised land" they lived under extremely primitive conditions.
Andrew married Rachel Merrill about 1771. The marriage would have taken place within the bounds of Guilford County, where a great majority of these marriage bonds have been lost. This is a matter if inference -- not documentation --but the evidence is quite strong.
When the Revolutionary war broke out (1775) every male 16 years of age or older, took his position in the conflict. The "Patriots" willingly signed the Oath of Allegiance to the State of North Carolina, assuming all of the responsibilities that were expected of them - serve in the militia, agree to bear arms and pay taxed for the support of the war effort. The Dutch Settlements comprised for the most part of Mennonites, Dunkers and Quakers, took the position of Christian "Pacifists", remaining neutral and refusing to take the Oath. They knew Full well that while their refusal was of a religious nature, it would mean the loss of their Civil Liberties for the duration of the war, among these, the right to purchase land.
David, Michael and all of their sons were staunch pacifists, with the exception of Andrew - the only Fouts in North Carolina, who by documented behavior, actively aided the Revolution. How does one account for this?
The Merrill's known as "fire brands", were among the most stalwart patriots of the Revolution and, no doubt, Andrew was greatly influenced by his in-laws. If he was to remain in the good graces of the Merrill family he could no remain neutral, but join them in the cause of liberty. His religion appear to be no barrier since he was a Baptist, as were the Merrills.
To further the Fouts/Merrill marriage by inference, Andrew's youngest daughter was named Penelope, definitely a Merrill family name. Those researching the Merrill family are in agreement with this marriage and the conjuncture that William Merrill's wife was named Penelope. Some time later when Andrew made his will he appointed Zaza (Zachariah) Merrill, son of Dan, the executor of his Estate, although his son Andrew, Jr. was living in the area. Still later, one of Andrew's grandsons (son of David) in Washington Co., IN, bore the name of Merrill Fouts. In the Deeds and County Court records there are many instances where Andrew and his immediate family cross-bonded with the Merrills"s.
When the Revolutionary war began, Andrew was 24 years of age, married with two or more children. The first land Entry in the Uwharrie issued to Andrew is as follows:
19 Nov 1778 - Andrew Fouts, File No. 30, Entry No. 621, Guilford Cty., 200 acres on waters of the Uhary, beginning at Stutsman's corner, bounding Stutsman on the south. (Guilford Co. Book 49, page 174)
27 October 1782 - State of North Carolina to Andrew Fouts, Grant No. 29: 200 acres on waters of the Uhary, beginning at Stutsman's corner, bounding Stutsman on the south. Chain carriers on Survey:

The fact that Andrew made this Entry and received his Grant, while the war was in progress, supports the contention that Andrew took the Oath of Allegiance.
To understand the geographical layout, Andrew's land bounded the Randolph-Rowan (now Davidson) line in Randolph Co., on both sides of the Rich Fork of the Uwharrie, Arthur Parr and James Morgan held land bounding the same line, but on the Rowan (now Davidson) side. Some land that Andrew, Sr. held in Rowan Co., (now Davidson) and later gave to his sons, David and Andrew, was located between Morgan's and Parr's. The Merrill's owned the land bounding Andrew on the North. Andrew retained this original grant throughout his lifetime and, while he bought and sold property, this was his homestead. In March 1779 Randolph County was formed out of the south end of Guilford and the name of Andrew Fouts appears in the 1779 tax list.
Over the years, beginning in 1780's, the Dutch left the Uwharried, scattering throughout Ohio, Indiana, Illinois, Kentucky, Missouri and some in distant states, while Andrew alone remained. He owned some of the best farm land in the "Rich Lands of Uwhary"; and what Andrew didn't have of those lands, the Merrill's had.
All of the children of Andrew and Rachel married within their community - the Osborn's, Morgan's, Allen's, Merrill's and John Fouts, Sr. ( a cousin), all lived within a three mile radius of Andrew Sr's. plantation. This was essentially a Baptist neighborhood. The Merrill's were strong Regular Baptists who helped found the Jersey Settlement on the north side of the Yadkin in Rowan (now Davidson) County in the mid-1750's.
From the Randolph County Deeds we know that Andrew continued to buy and sell land, and in some instances, from the German Steelers as they made plans to leave Uwharrie. Andrew sold (or gave) land to all of his sons-in-law and sons, with the exception of William and Noah, who may have preferred a case settlement.
Of all the Fouts in Randolph Co., Andrew was the only one who served on grand and petit juries virtually from the beginning of the County, and remained involved with the Randolph County Court for fifty years -- hence, he is frequently found on jury lists and being given court commissions--
May Term 1811 - order that Andrew Fouts (naming 13 others and Dan Merrill) to lay off a road - from Hoover's Mill to Park's Mill - Andrew appointed overseer.
May Term 1813 - Ordered that John Fouts (of John Sr.)...Andrew Fouts (Jr.)...Dan Merrill...Jacob Varner...Andrew Fouts, Sr...to view and extend the new road from Jacob Varner's to the Cucumber Road at the County line..
November Term 1818 - Andrew Fouts, Sr. and Andrew Fouts, Jr. both qualified as petit jurors for term of court.
Term 1821 - Andrew Fouts, Sr., 70 years old in 1821, was excused from further court calls.

Andrew, Sr. left all of his real and personal property to his unmarried daughter, Penelope, in order to guarantee her, and his wife Rachel, a home so long as they lived. In the 1840 Census of Randolph County, NC we find pg 111 Nelly Fouts 1 female 40-50.
Zaza C. Merrill apparently was a nephew.
In the November 1850 Term of Court, three of the heirs then living in Polk Cty, Missouri (William H. Goldsberry, Phillip Copple and Michael Fouts) granted unto Julius T. Goldsberry the Power-of-Attorney to act for and dispose of the assets to their benefit. (Will Book 28:264).
The family of 8 children is based on Andrew's Will written in 1834; also, the 1790 Census of Randolph County. There is proof of birth dates of two of the children - David born in April 1780 and Noah in August 1785. Working backward allowing two years per child, the first born would be in 1772 and the marriage c1771 in Guilford County, NC
Census of 1800, pg 210, must be this Andrew.

According to Fouts Newsletter, No 11, pg 5, in 1850 Henry Fouts, younger son of Andrew Sr, still held land in Randolph Co, NC. He and David a son of Andrew Jr. were the only Fouts remaining in the land by the Uwharrie. Henry's land went shortly thereafter to debt.

Esther's will recorded (in German) May 30, 1825. Recorded 16 June 1825. The estate of Jacob Yount was administered the September term of court 1813 by Esther Yount, and in 1815 January term Esther is guardian of a minor, Peter Yount, aged 19 years (born 1796). In 1817, May term we find Jacob Yount age 17 yrs (born 1800) heir of Jacob Yount. From the land records we find that children of Jacob and Esther (Fouts) Yount to be: Mary Yount, who married Jacob Wolf; Catherine Yount, who married David Hoover and settled in Wayne County IN; Joseph Yount (no record); Peter Yont born in 1796; Sarah, married Henry Gebhart, born in Berks county, PA 1799 (son of John George Gebhart to Ohio 1804); Jacob Yount, born 1800 died 1894 married Rebecca Waymire.
